    How to file for divorce in India?

    Deciding to get a divorce is a difficult and emotionally taxing decision. If you have come to the conclusion that divorce is the best option for you and your spouse, there are a few things you need to know about how to file for divorce in India.

    The first thing you need to do is collect all of the necessary documents. These include your marriage certificate, birth certificates for any children you have, and any financial documents such as bank statements and tax returns. Once you have all of these documents, you will need to fill out a divorce petition and file it with the court.

    The next step is to serve your spouse with the divorce papers. Once your spouse has been served, they will have 30 days to respond to the divorce petition. If they do not respond, the court will grant you a default judgment and the divorce will be finalized.

    If your spouse does respond, the two of you will need to attend a mediation session where you will try to reach an agreement on the terms of your divorce. If you are able to reach an agreement, the mediator will prepare a settlement agreement which will be submitted to the court for approval. If you are not able to reach an agreement, the case will go to trial and a judge will decide how to divide assets and custody of any children.

    2. Once the petition is filed, the court will issue a summons for both spouses to appear before the judge.
    3. If both spouses appearing and agree to the divorce, the judge will grant an annulment and issue a decree of divorce.
    4. If one spouse does not appear or if both spouses do not agree on the terms of the divorce, then the court will hear evidence from both sides and make a decision on whether to grant an annulment.
    5. Once an annulment is granted, either spouse can remarry.
